However, product colors, beam appearance, light output, perceived brightness, product appearance, and other visual characteristics may differ from photographs, videos, renderings, or what appears on your screen due to camera settings, exposure, display settings, ambient conditions, installation, power source, vehicle configuration, and other factors.
We do not warrant that the appearance or performance of any product will be identical to photographs, videos, demonstrations, or other depictions shown on our website.
Product descriptions, specifications, availability, pricing, and features may change at any time without notice. We reserve the right to discontinue any product or limit quantities offered to any person, geographic region, or jurisdiction.
OFF-ROAD AND NON-PUBLIC-ROAD USE
Unless a product is expressly identified by RUBY Moto as certified, approved, or legal for on-road use in the applicable jurisdiction, all lighting products and other vehicle-related products manufactured, sold, supplied, distributed, or marketed by RUBY Moto are intended solely for off-road, closed-course, track, competition, exhibition, agricultural, private-property, or similar non-public-road use.
RUBY Moto products are not intended to be used on public streets, highways, or other public roadways where their use is prohibited or where they do not satisfy applicable equipment, lighting, vehicle, or transportation laws.
A product's ability to be physically installed on a street-legal vehicle does not mean that the product itself is approved, certified, or lawful for use on public roads.
ONCOMING TRAFFIC AND OTHER ROAD USERS
High-output auxiliary lights, driving lights, spot lights, flood lights, combination-beam lights, and similar lighting must never be operated in a manner that directs excessive light toward oncoming traffic or other road users.
RUBY Moto auxiliary lighting must never be used when facing or approaching oncoming traffic in a manner that could impair, distract, dazzle, temporarily blind, or otherwise interfere with another person's ability to safely operate a vehicle.
Auxiliary lighting should also be dimmed, disabled, redirected, or otherwise operated appropriately when following another vehicle, approaching pedestrians, cyclists, other riders, or whenever its output could negatively affect the vision or safety of another person.
The purchaser, installer, vehicle owner, and operator are solely responsible for determining whether the installation and use of any RUBY Moto product complies with all applicable federal, state, provincial, municipal, local, and other laws and regulations.
Vehicle and lighting laws vary substantially by jurisdiction. RUBY Moto does not represent or warrant that any product is legal for public-road use in any particular jurisdiction unless expressly stated in writing by RUBY Moto.
By purchasing, installing, or using a RUBY Moto product, you agree to use it responsibly, comply with all applicable laws, and discontinue or disable any lighting whenever its use could create an unsafe condition or interfere with other road users.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase products or services from RUBY Moto.
We reserve the right to accept, reject, limit, or cancel any order for any lawful reason and at our discretion.
Your order is not accepted until we confirm acceptance. Payment must be authorized and processed before an order is completed.
Please review your order carefully before submitting it. Depending on how quickly an order enters fulfillment, we may not be able to accommodate cancellation or modification requests after an order is placed.
If we reject, modify, or cancel an order, we may attempt to notify you using the email address, billing address, shipping address, or phone number supplied with the order.
Purchases are subject to our applicable Refund and Return Policy.
Unless otherwise agreed in writing, you represent that purchases are for your personal, household, business, or authorized end use and not for unauthorized resale, fraudulent export, or other unlawful purposes.

We are not responsible for delays caused by carriers, customs authorities, weather, natural disasters, labor disruptions, transportation interruptions, incorrect addresses, government action, or other events outside our reasonable control.
Where permitted by law, risk of loss may pass to you when the order is transferred to the shipping carrier.

RUBY Moto names, logos, product names, designs, slogans, and related branding are trademarks or other proprietary identifiers of RUBY Moto or our affiliates or licensors.
Shopify and other third-party marks appearing through the Services remain the property of their respective owners.
Nothing in these Terms grants you ownership of or a license to RUBY Moto intellectual property except for the limited right to use the Services in accordance with these Terms.

RUBY Moto's online store is powered by Shopify, which provides e-commerce technology that enables us to offer products and Services online.
Purchases from RUBY Moto are transactions between you and RUBY Moto, not between you and Shopify.
To the extent permitted by law, Shopify is not responsible for RUBY Moto products, product claims, warranties, fulfillment, customer service, injuries, losses, or disputes arising from transactions between you and RUBY Moto.

Personal information we collect through the Services is handled in accordance with our Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUBY MOTO DISCLAIMS IMPLIED WARRANTIES OR CONDITIONS INCLUDING MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, AND NON-INFRINGEMENT.
NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
SECTION 17 - LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUBY MOTO AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, LOSS OF USE, BUSINESS INTERRUPTION, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS.
THIS LIMITATION APPLIES REGARDLESS OF WHETHER A CLAIM IS BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANOTHER LEGAL THEORY, AND EVEN IF THE POSSIBILITY OF SUCH DAMAGES HAS BEEN DISCLOSED.
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
SECTION 18 - INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless RUBY Moto and its owners, affiliates, officers, directors, employees, agents, contractors, licensors, suppliers, and service providers from third-party claims, damages, losses, liabilities, costs, and reasonable attorneys' fees arising from:
(a) your material breach of these Terms;
(b) your violation of applicable law;
(c) your infringement of the rights of a third party; or
(d) your unlawful or unauthorized use of the Services.
We may control the defense of an indemnified claim where permitted by law, and you agree to reasonably cooperate in the defense.
SECTION 19 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.
The remaining provisions will remain in full force and effect.

You may not assign or transfer your rights or obligations under these Terms without prior written consent from RUBY Moto.
RUBY Moto may assign or transfer its rights or obligations in connection with a merger, acquisition, reorganization, sale of assets, financing transaction, corporate restructuring, or other lawful business transaction.

To the extent permitted by law, you consent to the jurisdiction of courts having proper jurisdiction where RUBY Moto is headquartered.

PROGRAM NAME
The text messaging program is the RUBY Moto Customer Support Text Messaging Program.
PROGRAM DESCRIPTION
RUBY Moto may use SMS and MMS text messaging to communicate with customers and prospective customers regarding customer-support inquiries, missed calls, voicemail follow-up, product questions, installation assistance, warranty matters, order status, shipping questions, returns, service communications, and other customer-care matters.
By providing your mobile telephone number and expressly opting in to receive text messages from RUBY Moto, you consent to receive SMS or MMS messages from RUBY Moto at the mobile number you provided.
Consent to receive text messages is not a condition of purchasing any product or service.
MESSAGE FREQUENCY
Message frequency varies based on your interactions with RUBY Moto and the nature of your customer-support request, transaction, or ongoing conversation.

CARRIER LIABILITY
Wireless carriers are not liable for delayed or undelivered messages.
SUPPORTED CARRIERS
Message delivery is subject to the availability and capabilities of your wireless carrier and mobile device. Not all carriers, devices, or geographic areas may support all messaging functionality.
PRIVACY
RUBY Moto's collection, use, storage, and protection of personal information associated with text messaging is governed by our Privacy Policy.
Mobile telephone numbers, SMS opt-in information, and text messaging consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
